Terms and Conditions

  1. Information on how to enter and prizes form part of these Terms and Conditions. Entry into the promotion is deemed acceptance of these Terms and Conditions. Entry is via mail in form only.
  2. Entry is only open to Australian residents. Employees (and their immediate families) of Ingham, participating retailers, Beyond the Square Communication, printers, suppliers, providers and agencies associated with this promotion are ineligible to enter.
  3. The Promoter reserves the right, at any time, to verify the validity of all entries and entrants (including an entrant’s identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or tampers with the entry process. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
  4. To be eligible to enter, individuals must purchase, in a single transaction, a minimum of 200g of any Inghams or Woolworths brand turkey fresh or deli products from any participating Woolworths or Safeway store. To enter, individuals must then complete the official entry form, attach original receipt and send to Turkey—Fire it up! Competition, 3/780 Darling Street, Rozelle, NSW 2039 during the promotional period. Original receipt required to claim a prize.
  5. Multiple entries are permitted, subject to the following:(a) only one entry permitted per specified purchase requirement; and (b) each entry must be submitted separately and in accordance with entry requirements.
  6. The promotion commences on 3rd November 2008 at 09:00 (AEDST). Entries close last mail received on 1st December 2008 (AEDST).
  7. The prize draws will take place at 11:00 (AEDST) on 2nd December 2008 at Beyond the Square, 3/780 Darling Street, Rozelle NSW 2039. Winners will be notified by phone and mail. Winners’ names will be published in the public notices section of The Australian newspaper on 13th December 2008. The Promoter’s decision is final and no correspondence will be entered into.
  8. The first two (2) valid entries drawn will each win one Apollo Premium 5 barbeque on cart (RRP $3,999), total value of the prize is $7998.00. The next ten (10) valid entries drawn will each win a Barbeque Prize Pack including Utah oval party tub with opener (RRP $59.95), Maple smoking wooden planks (RRP $29.95), Bar-B-Chef 3 piece tool set (RRP $29.95), Bar-B-Chef Fisharoo grill basket (RRP $19.95), Two Smokey BBQ marinades (RRP $5.00 each), Two sweet chili relishes (RRP $5.99 each), total value of each prize pack is $161.78. Total value of all prizes in promotion is $9,615.80
  9. Prizes must be taken as offered and cannot be varied. Each prize must be taken in the winner’s name and is not transferable or exchangeable and cannot be taken as cash. Prize values are GST inclusive, are in Australian dollars, are the recommended retail value as provided by the supplier and are correct at time of printing.
  10. If the winner of any prize is under the age of 18 years, the prize will be awarded to the winner's nominated parent or guardian.
  11. If any prize (or part of any prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.
  12. A draw for any unclaimed prizes may take place at 11:00 (AEDST) on 2nd March 2009 at the same place as the original draw, subject to any directions from a regulatory authority. Any winners will be notified by mail and winners’ names (for prizes over $100) will be published in the public notices section of The Australian newspaper on 7th March 2009.
  13. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.
  14. Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) use of a prize.
  15. The Promoter collects personal information in order to conduct the Promotion and may, for this purpose, disclose such information to third parties, including, but not limited to, prize suppliers and as required, to Australian regulatory authorities. Entry is conditional on providing this information. The Promoter may, for an indefinite period unless otherwise advised, use the information for promotional, marketing and publicity purposes including sending electronic messages or telephoning the entrant. Entrants should direct any request to access, update or correct information to the Promoter. All entries become the property of the Promoter.
